General Terms and Conditions: Lami Super Booster

1. General Provisions and Scope

1.1 These General Terms and Conditions (the Conditions) govern the legal relationship between Paradiisi Ilu OÜ (registry code: 14453531, address: Tööstuse 99-8, 10416, Tallinn, Estonia, hereafter the Seller) and the customer (hereafter the Purchaser) using the online store at www.lamisuperbooster.com (the e-Store).

1.2 The Seller reserves the right to amend these Conditions at any time. The Conditions in force at the time the order is placed shall apply to the transaction.

1.3 In addition to these Conditions, the legal relations arising from the purchase of products from the e-Store are regulated by the laws of the Republic of Estonia and the European Union.

2. Product Information and Professional Use

2.1 Illustrative Images: Product images are for illustrative purposes only. Packaging or minor design elements may vary.

2.2 Professional Use Disclaimer: Many products sold in the e-Store (e.g., chemical lash lift solutions) are intended for professional use only. By purchasing these products, the Purchaser confirms they possess the necessary training and qualifications. The Seller is not liable for damages resulting from improper use by unqualified individuals.

2.3 Pricing: All prices include VAT where applicable. Shipping costs are added during the checkout process.

3. Order Process and Payment

3.1 Formation of Contract: A Sales Contract is deemed concluded once the order is placed and the full purchase amount is credited to the Seller’s bank account.

3.2 Payment Processing: Payments are handled via EveryPay AS. The Seller is the controller of personal data and forwards necessary data for payment execution to EveryPay AS.

3.3 Right to Cancel: The Seller reserves the right to cancel an order if there is a clear pricing error (e.g., technical glitch), if the item is out of stock, or if the Purchaser’s data is incomplete.

4. Shipping and Delivery

4.1 Processing: Orders are dispatched Monday–Friday. Orders placed before 12:00 PM (EET) are typically dispatched the same day.

4.2 Logistics Partners:

  • Estonia: Itella SmartPost, Omniva, Unisend, DPD Pickup.

  • Latvia: Unisend, Omniva, DPD Pickup.

  • Lithuania: Omniva, Unisend, DPD Pickup.

  • Finland & Sweden: DPD Pickup.

  • Global: MBE (FedEx, DHL, UPS, etc.).

  • 4.3 Responsibility: The Purchaser is responsible for the accuracy of delivery data. Paradiisi Ilu OÜ is not liable for delays caused by the courier or incorrect information provided by the Purchaser.

  • 4.4 Non-Collection: If a parcel is returned to the Seller because the Purchaser failed to collect it within the carrier’s timeframe (usually 7 days), the Seller reserves the right to deduct the return shipping and handling costs from any refund.

5. Right of Withdrawal and Returns (EU Consumers)

5.1 14-Day Window: Under EU Law, consumers have 14 days to withdraw from the contract without reason. This period begins when the Goods are received.

5.2 Hygiene and Health Protection: Pursuant to the Law of Obligations Act (VÕS § 53 (4)), the right of withdrawal does not apply to products that are:

  • Delivered in sealed packaging and have been opened/unsealed after delivery.

  • Not suitable for return due to hygiene or health protection reasons.

  • 5.3 Exchanges: We accept the return of unopened products if the client wishes to exchange them.

  • 5.4 Faulty Goods: We accept returns of defective/faulty products. Please report defects immediately to info@lamisuperbooster.com with photos of the defect.

  • 5.5 Return Costs: Direct costs of returning the Goods are borne by the Purchaser unless the item is faulty.

6. Liability and Force Majeure

6.1 The Seller is liable for the non-compliance of the Goods within two years from the date of delivery to a consumer (1 month for business-to-business transactions). 6.2 The Seller is not liable for:

  • Damage caused by the Purchaser’s intent or negligence.

  • Defects caused by improper storage or use.

  • Force Majeure: Delays caused by circumstances beyond the Seller’s control (natural disasters, strikes, customs delays).

7. Intellectual Property

7.1 All content on www.lamisuperbooster.com, including text, graphics, logos, and images, is the property of Paradiisi Ilu OÜ. Any unauthorized use or reproduction is strictly prohibited.

8. Privacy and Data Security

8.1 The Seller processes personal data in accordance with the GDPR. Data is used only for fulfilling orders and, with the Purchaser’s consent, for marketing purposes. 8.2 Secure SSL encryption is used for all transactions to protect the Purchaser’s financial information.

9. Dispute Resolution

9.1 If a dispute cannot be resolved through negotiation, the Purchaser may contact the Estonian Consumer Protection and Technical Regulatory Authority (Pronksi 12, 10117 Tallinn). 9.2 EU residents may also use the Online Dispute Resolution (ODR) platform: http://ec.europa.eu/consumers/odr/.
